Stint Business User Privacy Notice

Stint Ltd, a company registered in England under number 11022621, with its registered office at The Retreat, 406 Roding Lane South, Woodford Green, Essex, England, IG8 8EY, is the “data controller”. This means that Stint Ltd is responsible for deciding how it holds and uses personal information relating to users of the Stint Business App (“Business User” or “you”). “Personal data”, or “personal information”, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

Personal data Stint collects on Business users

1. Information you provide. This may include:

User profile: for a business to create an account on Stint we require a representative of that business input details about themselves. This includes your name, email address and phone number.

If you fail to provide certain information when requested, Stint may not be able to register you for the Stint Business App or suggest/provide any Students to carry out stints.

2. Information created when using our services. This may include:

Communication data: we communicate with potential Business Users and current Business Users of Stint on the phone, by email and on WhatsApp. We may keep a record of this correspondence.

Marketing data: we may use our correspondence with individuals to generate information on how you respond to email, phone, messaging, social media, text and post campaigns.

3. Information we do not collect:

We do not collect any special categories of personal data about Business Users (this includes details about your race or ethnicity, religious of philosophical beliefs, sexual orientation, political opinions, trade union membership, information about your health and genetic and biometric data – these categories are classed as high risk by GDPR). Nor do we collect any information about criminal convictions and offences from Business Users. The only exception to this is if you choose to make this information manifestly public by including it in your profile on the Stint Business App or share it as part of a Stint Request.

How Stint uses your personal data

Stint uses the personal data of Business Users for purposes including:

1. To provide and improve the services and features we offer Business Users. This includes the information to:

Create and update your Business User account.

Verify your identity and ensure you are a genuine representative of a Business and therefore qualify to be a user of the Stint Business App.

Have a personal point of contact within a Business so we can set up initial outreach and onboarding meetings to sell our service to Businesses, get them on the App and enable you to post stints on the App.

2. Business User support. This may include:

Communicating with an individual representative of a Business to ensure we are maintaining a satisfactory quality of service.

For example, responding to a Business User posting a bad review about a Stinter, responding to any questions or problems a Business User may have with the App, notifying Business Users that a large updated version of the App is available for download, seeking feedback on how we can improve our services and what features of the platform they like, dislike or would like to see created.

3. Safety and security.

In the event of an emergency on a stint it is useful to have an individual contact within the Business to help us stay up to date and organise help any assistance needed for the safety of any Stinter on site.

4. Communications from Stint. This may include:

For marketing purposes: To share our news, offers and services, we may use direct marketing by email, phone, messaging, social media, text and post. Your direct marketing preferences are made clear on the Stint Business App, and you can ask us about these at any time.

When invoicing your Business for a Completed Stint.

5. Hearings, termination and disputes

Gathering evidence for possible grievance or disciplinary hearings in relation to Students.

Making decisions about your continued use of the Stint Business App; making arrangements for the termination of your use of the Stint Business App in accordance with the Stint Business Terms.

Dealing with legal disputes, claims, or other legal or administrative or regulatory actions; or investigations involving Students, or other employees, workers and contractors of Stint, or any Business or Business User (including in relation to health and safety or other compliance with law).

Sharing your data

Stint may share the data we collect:

1. With Student Users of Stint

This is done occasionally to ensure the smooth operation of our matching services. For example, if a Student is having problems finding the location of a stint we may share your name and contact details with the Student so they can contact you and keep you up to date on their arrival.

2. With third party service providers

Stint will share personal information with third parties where required by law, where it is necessary to administer the contract between us and your Business or where we have another legitimate interest in doing so.

We share personal data with third parties as follows:

With our database service providers, including Firebase (httpsss://firebase.com);

With our instant messaging service providers, including WhatsApp (httpsss://whatsapp.com) and Freshworks (httpsss://freshworks.com);

With our sales engagement provider, including Outreach (httpsss://outreach.io)

With other suppliers. We may, for example, engage a supplier to carry out administrative and operational work in support of our relationship with a Business and Business Users. The supplier(s) will be subject to contractual and other legal obligations to preserve the confidentiality of data and to respect privacy, and will only have access to the data they need to perform their functions; the relevant suppliers are typically IT suppliers (who provide, host or support our IT systems, including information about Business Users) and back office finance and accounting management providers (who might need to handle details of students in order to process accounts payable and receivable).

3. With other third parties outside of the EU

Stint may transfer the personal information we collect about Business Users outside the EU. Where Stint does so it will ensure that it complies with the rules for international transfers under the GDPR (for example, the country is on the EU’s list of adequate countries, the third party is Privacy Shield certified, or there are EU Model Clauses in place).

4. With other entities in our group of companies

Stint will share personal information with other entities in our group as part of our regular business operations and reporting activities on company performance, in the context of a business reorganisation or group restructuring exercise, for system maintenance support and hosting data.

All our third-party service providers and other entities in the group are required to take appropriate security measures to protect personal information in line with our policies. we do not allow our third-party service providers to use personal data for their own purposes. Stint only permits them to process personal data for specified purposes and in accordance with our instructions.

Retaining and deleting your data

Stint will only retain personal information for as long as necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of personal data, the purposes for which we process personal data and whether Stint can achieve those purposes through other means, and the applicable legal requirements.

In some circumstances, Stint may anonymise personal information so that it can no longer be associated with you, in which case Stint may use such information without further notice to you. Once a Business User is no longer a registered user Stint will retain and securely destroy personal information in accordance with applicable laws and regulations.

Your rights

Under certain circumstances, by law you have the right to:

Request access to personal information (commonly known as a “data subject access request”). This enables you to receive a copy of the personal information Stint holds about you and to check that we are lawfully processing it.

Request correction of the personal information that we hold about you. This enables you to have any incomplete or inaccurate information we hold about you corrected.

Request erasure of personal information. This enables you to ask us to delete or remove personal information where there is no good reason for us to continue processing it. You also have the right to ask us to delete or remove personal information where you have exercised your right to object to processing (see below).

Object to the processing of personal information where Stint is relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on these grounds. You also have the right to object where we process personal information for direct marketing purposes.

Request restriction of processing of personal information. This enables you to ask Stint to suspend the processing of personal information about you, for example, if you want Stint to establish its accuracy or the reason for processing it.

Grounds for our processing your data

Stint processes your information based on one or more of the legal bases specified under GDPR:

1. Processing your personal data is necessary to provide the services we offer and you request i.e. we need this information to fulfil our contractual obligations to you or to ensure you fulfil your contractual obligations to us. The information that is necessary includes:

User profile information to create and maintain your account, including verifying your identity as a genuine representative of a Business; enable communication with you about your experience with stints posted in your Business.

Usage information used to maintain, optimize and improve Stint’s offering to Businesses and Students. For example, providing you with extra information about your stint posting or a Student assigned to your stints.

2. Stint has a legitimate business interest in processing your data. This information is for:

Customer service: Communicating and developing a personal relationship with an individual from your Business allows us to better monitor your experience with Stint and provides an outlet for you to provide feedback, ask questions and maximise Stint’s offering to save you money on labour costs.

Safety and security: Using an individual’s personal information allows us to verify they are a genuine representative of a business and therefore ensures the safety of our sales team who go to meet potential Business Users and Student Users of the App. We may use a Business User’s personal data to help protect a Student User’s safety while on a Stint – by checking with a Business if a Student appears on our systems to not have turned up, or if a Student has a medical emergency while on a Stint.

Optimizing our service and developing new features: Receiving feedback on a Business User’s experience with Stint is essential for us better understanding how we can improve our offering to Businesses i.e. what new features of the App could help improve Business’ user-experience.

3. Processing your personal data is necessary to protect the vital interests of Student users:

Stint may process personal information, including disclosing data with law enforcement authorities in case of threats to the lives of Business or Students Users or of others.

The mostly likely scenario where this justification may be invoked is in the event a Stint Student has a medical emergency while doing a Stint and their life is in danger. In this circumstance, the personal contact information of a Business representative where that Student is working may be used to help protect that Student from further harm.

4. Consent:

Direct marketing purposes: As a Business User we are permitted by law to send you unsolicited direct marketing about Stint and the services we offer to our Business customers without requiring your prior consent. However, you can opt out of this at any time. The easiest way to do this is to click the unsubscribe link at the bottom of your email or contact privacy@stint.co.

In the limited circumstances where you may have provided consent to the collection, processing and transfer of any personal information for a specific purpose, you have the right to withdraw consent for that specific processing at any time. To withdraw consent, please contact privacy@stint.co or update preferences in the Stint Business App. Once we have received notification that you have withdrawn consent, we will no longer process information for the purpose(s) you originally agreed to, unless Stint has another lawful basis for doing so.

Changes to this privacy policy

Stint reserves the right to update this privacy policy at any time. We will provide you with the new privacy policy when we make any substantial updates. We may also notify you from time to time about the processing of your personal information through the Stint App or through other means such as email. We encourage you to review this privacy policy regularly for the latest information on our privacy practices.

Personal data Stint collects on Student Users

1. Information you provide. This may include:

User profile: for a Student to create an account on Stint we require they input details about themselves. This includes your name, university, university email address, university degree, mobile phone number, year of graduation, date of birth, home address, work experience (if any), details of work experience, profile picture, payment information (including bank account details and national insurance number), student loan information and password.

Emergency information: emergency contact name and emergency contact phone number is processed in the unlikely event a Student is involved in an emergency while on a stint.

Right to work information: by law we need to verify your right to work in the UK, we therefore process a copy of your passport (if British or EEA) or BRP card.

Stint preferences: this includes information you provide on your future availability to do stints including the dates and times of day you want to do stints, and areas you aren’t willing or able to work in as a Stinter (e.g. not working with alcohol or in heavy lifting).

User content: this includes your answer to the question ‘How did you hear about Stint?’

2. Information created when using our services. This may include:

Marketing data: we may use our correspondence with individuals to generate information on how you respond to email, phone, messaging, social media, text and post campaigns.

Communication data: we communicate with Student Users on the phone, by email and on WhatsApp. We may keep a record of this correspondence.

Location information: depending on your device permissions Stint may collect your precise or approximate location. We collect this information when the Stint App is running in the foreground or background of your device.

Student Users can still use the Stint App without enabling location tracking but this may hinder our ability to match you to stints that are within a reasonable distance to your location.

Device information: we may collect data on the device you use to access the Stint App such as your battery level and device motion information.

3. Information provided by other sources. This may include:

Verification meeting feedback: this includes a comments on your work experience and on factors including your politeness, presentability and English-speaking ability.

Business User feedback on your Stint performance: this includes an overall rating out of 5; category ratings out of 5 on your personality, attitude, presentability, English-speaking ability, uniform and lateness; bad ratings tags on lateness, uniform, skills and attitude; and comments made by Businesses on your performance.

4. More sensitive data:

Health problems: we ask you to provide us with information on any health issues that may hinder your ability to do certain stints so we can assign you to stints suited to you. For example, allergies, physical injuries or disabilities.

How Stint uses your personal data

Stint uses the personal data of Student Users for purposes including:

1. To provide and improve the services and features we offer Student Users. This includes the information to:

Create and update your Student User account.

Verify your identity and ensure you are a university student or within one year of graduation, and therefore qualify to be a user of the Stint Student App.

Verify your eligibility to work in the UK.

Match Students to stints appropriately and efficiently. This is done either manually (in which Students are contacted directly by Stint HQ) or we use an algorithm. Both methods of matching consider experience (if necessary), attitude and personality; a Student’s university; a Student’s degree; a Student’s willingness/ability to do certain work (e.g. if they are unable to work with alcohol for religious reasons); and a Student’s location (including saved preferred locations to do stints), minimizing waiting time for Businesses and travel costs for Students.

Be able to pay you for a Completed Stint.

Using Business User ratings of Students to encourage improvement in Student performance, and as grounds for deactivating Student Users with ratings below a certain minimum where the reputation of Stint’s of service to Business Users is in jeopardy.

2. Student User support

Stint uses the information we collect (including recordings of customer support calls after notice to you and with your consent) to assist you when you contact our customer support services, including to:

Direct your questions to the appropriate customer support person,

Investigate and address your concerns,

Monitor and improve our customer support responses.

3. Safety and security. This may include:

Tracking your location before a stint to ensure you are not lost or require assistance with travel.

Processing your name and profile picture so the Business whose stint you are attending knows the identity of the Student prior to your arrival.

4. Communications from Stint. This may include:

Stint may use the information we collect to communicate with you about products, services, promotions, studies, surveys, news, updates and events.

Stint may also use the information to promote and serve you relevant ads and content about our services and those of our business partners. You may receive some of these communications based on your profile as a Student User. You have the right to object to this type of processing.

5. Hearings, termination and disputes

1. With Business Users of Stint

Businesses need to know for security and operational reasons who is coming to their posted stint. We therefore share a limited version of your profile with Business Users when you are matched to their Stint posting. This limited profile includes your name, profile picture, university and overall rating.

2. With third party service providers

Stint will share personal information with third parties where required by law, where it is necessary to administer the contract between us and you or where we have another legitimate interest in doing so.

We share personal data with third parties as follows:

With our payroll service providers, including Virtual Business Source (PayPlus at httpsss://payplus.co.uk);

With our database service providers, including Firebase (httpsss://firebase.com) and Salesforce (httpsss://salesforce.com);

With our instant messaging and customer service messaging providers, including WhatsApp (httpsss://whatsapp.com) and Zendesk (httpsss://zendesk.co.uk/);

With our email and file sharing applications and providers, including Gsuite, Sendgrid

Grounds for our processing your data

Stint processes your information based on one or more of the following legal bases specified under GDPR:

1. Contract

Our primary offering as a company is to match Students to Businesses for short-term work. We are therefore contractually obliged, whether implicitly through our marketing, sales and description of our services, or explicitly through your agreement to our Student Terms, to do this effectively. Therefore, we need to process:

User profile information necessary to establish and maintain your account, including to verify your identity; enable communications with you about your stints; enable you to receive earnings; and better ensure stints match your personal experience/abilities. Students also agree to supply this data in our Terms.

Right to work information necessary to allow Students to provide work through the Stint App – Stint hires Student Users as workers as per the Stint Contract.

Student location information, which is necessary to match Students to stints, and to track Students prior to a stint, help with travel and ensure punctuality for Business Users.

Student availability information, which is necessary to match Students to stints.

Payment information, which is necessary to ensure you are compensated for the work you provide through the App.

Other information to enforce and comply with our Student User Terms.

2. Legitimate interests

In some cases stint may use the personal information of Student Users to pursue our legitimate business interests, provided Students’ interests and fundamental rights do not override those interests. These cases include:

To provide customer support.

To optimize our service. This includes our rating system which helps us identify the best Students on the App (we do this so we can send them to our most valuable Business Users), maintaining a minimum quality of Student User on the App by removing those who consistently fail to meet the expectations of Business Users; enhancing the pricing and matching of Students with Business Users.

For research and analytical purposes. This includes, for example, analysing usage trends to improve the user experience and enhance the safety and security of our services.

For direct marketing purposes. This includes, for example, analysing data to identify trends and tailor marketing messages to user needs.

3. Vital interests

Stint may process personal information, including disclosing data with law enforcement authorities in case of threats to the safety of users or of others.

This is our justification for processing any health problems Student Users have – in order to be able to protect against sending Students to stints that may put them in serious physical danger.

4. Legal obligation

We are required by law to ensure Student Users have the right to work in the UK. We also need to process copies of passports or BRP cards for this purpose and to show our compliance in the event of any regulatory investigation.

Stint may share information with law enforcement, or requests by third parties pursuant to legal processes.

5. Consent

We also rely on consent for the following processing:

Health problem information: Health data is classified as high risk by the GDPR, we therefore require your explicit consent to process it. By inputting your health problems into our App you are consenting to providing it to us. You do not have to input any health problems and you can remove them from your profile at any time.

Your comments on Business Users: when you have worked with a Business for a stint it is optional for Students to comment on your experience. We therefore only process this data when Students voluntarily provide it to us and Students can delete their comments at any time.

In the limited circumstances where you may have provided consent to the collection, processing and transfer of any personal information for a specific purpose, you have the right to withdraw consent for that specific processing at any time.
